Sound Marketing” is a marketing method that aims for more effective promotion by combining various sounds (music, voice, simple noises, etc.) that can be perceived through hearing, in addition to traditional verbal and visual expressions. “Sound Branding” is a new branding method for companies and services that utilizes the results of sound marketing.

Hearing controls a large part of the brain’s perceptual functions, alongside vision, and is said to have a significant impact on memory, which can enhance promotional effects in various situations. A study by the University of Leicester (external link) found that sound branding using sound logos improved brand recall by 96% and increased product purchase rates by 24%.

About Copyright

1.When is copyright transfer necessary?

Copyright is broadly divided into two parts: economic rights and moral rights.
After hearing from customers about their usage, we will transfer the economic rights upon request and include a clause in the contract stating that the moral rights will not be exercised (*).

※The transfer of moral rights itself is not possible under the law.

When transferring copyright, all neighboring rights are also transferred simultaneously, allowing customers to use the delivered audio in various forms and purposes indefinitely without our permission. Since the option to waive moral rights is included, customers can decide whether to disclose the creator’s name (right of attribution) or the timing of publication (right of publication).

For example, if you want to use a sound logo produced for YouTube and then rearrange it for TV a year later, without a transfer agreement, you will need our permission each time you make changes or change the usage purpose. Depending on the content, additional usage fees may be incurred. Therefore, if such cases are anticipated, it is better to transfer the copyright from the start.

2.Use of music without copyright transfer

As mentioned in 1, since copyright includes various rights, if copyright transfer (including neighboring rights) is not performed, any use other than the agreed usage during production will require our consultation.

However, using our produced audio as it is without modification, for example, in other videos, is unrestricted and can be freely used. However, if any modifications or the creation of different versions that infringe on rights are found, we may contact you.

3.Why is there no copyright transfer setting for original songs?

We categorize original songs into “artist songs” and “corporate theme/imaging songs.” In either case, original songs are expected to be recorded and sold on CDs, and it is common to register with JASRAC and use them on various media. Therefore, we do not transfer copyright but instead establish a royalty contract with the creator separately from the production cost. Neighboring rights such as master rights can be transferred, so please feel free to consult if you are considering CD production.

In any case, as mentioned earlier, moral rights cannot be separated from the creator, so you may be asked to include credits depending on the usage situation.

4.テUse on television (terrestrial, BS)

CM songs and sound logos may also be used on television.

For TV commercials, the airing period is often set as one cour, two cours, etc. To avoid trouble, we generally request a copyright transfer regardless of the period. Additionally, there is a “competition” rule that restricts singers and narrators from appearing in advertisements for competing companies or similar products. If you require this, the fees may increase.

5.Use on radio

Similar to television, we recommend copyright transfer, but please consult us if you wish to keep production costs low due to budget constraints.

6.Use on the web

For works permanently available on YouTube or SNS, we recommend copyright transfer. Most video sites and SNS platforms have blanket contracts with copyright management organizations like JASRAC. By holding the copyright, you can avoid the risk of being prohibited from monetizing the video due to copyright infringement or having your SNS post deleted. If you upload directly to your company’s site, this problem does not occur, but if you link to YouTube or other platforms from your site, the above risks arise.

7.Use for sales purposes on CDs, streaming, etc.

As mentioned in 3, transferring neighboring rights, including master rights, allows customers to freely produce and sell CDs, etc. However, you will need to enter a royalty contract with the creator for the songs, as mentioned earlier. Since the creator retains moral rights, we generally request the inclusion of credits during sales.
